Terms and Conditions

 

The purpose of this contract is to protect both the customer (referred to as the ‘Customer’) and Limelight Media Productions Ltd; trading as Shepperson Wedding Films (referred to as the ‘Company’).

It is mutually agreed that the Company shall supply the services and goods specified in the Wedding Video Booking Form and that the Customer shall pay the price agreed.

 

Reservation of time and date: Upon signing this contract and receipt of the deposit, the company will reserve the time and date agreed upon, and will make no other reservations for the duration of the contract.

 

Payment: Payment is to be made in three instalments; a 20% deposit at time of booking then 40% due 14 days before the wedding day or event and the remaining balance including mileage costs before the completed wedding film will be handed over. Payments can be made in the form of cash, cheque, BACS transfer or credit/debit card payments via Paypal (subject to a 3.5% fee for the transactions). In the case of cheques please note that a booking cannot be confirmed until this payment has fully transferred into the Company bank account.

 

Changes and cancellations: The Company will make reasonable effort to work with the Customer should changes occur. If the event is rescheduled and if the Company is available, the Company will undertake the assignment at the current rates in effect at the time of change. If the Company is unavailable on the new date or the event is cancelled, funds already paid to the Company will not be refunded. The Company may request that any changes be notified in writing. Should the Company terminate the contract for any reason, all monies paid will be refunded. Should the Customer need to cancel the booking at any time the following cancellation charges apply:

 

1.More than ninety days prior  to the date = deposit only

2.Ninety days to thirty days prior to that date = deposit plus half the remaining cost

3.Less than thirty days prior to the date = full amount

 

On the Day:

  • The Company will operate in a discreet and unobtrusive manner but in low light conditions additional camera-mounted or free standing lighting may be required.
  • It is understood that the Company is the exclusive official videographer, and others taking video will be permitted only at the Companies discretion.
  • The Company will co-operate with reasonable requests made by photographer and other service providers and will abide by any restrictions imposed by clergy etc.
  • The Customer agrees to co-operate and assist the Company in all reasonable requests.
  • The Company will not request anything that would put the Customer at risk or embarrassment.
  • The Company will respect the requests of guests who do not wish to appear on video.
  • If the Customer requests extended coverage beyond the agreed length of time coverage, the cost of additional filming coverage and editing will be charged for as per the standard rates.

 

Production: The Company assumes ‘artistic license’ and the Customer will allow any and all videography, editorial control and/or artistic techniques used in the production or post production to be the discretion of the Company unless specifically agreed at the time of booking.

 

 

Restrictions: The Customer is aware that restrictions imposed by others (church/ registry office, photographer, guests, reception, etc.) and the constraints of the physical environment, safety, weather or other conditions outside the Company control can affect the quality and extent of the video coverage possible and the Company will not be responsible for scenes not included. The Customer is responsible for obtaining all permissions and clearances for the Company to film etc. particularly permission from clergy if applicable.

 

Liability and Guarantees: The Company will try to ensure that your event is filmed without any problems. The Company takes great care and maintenance of the equipment, but cannot be held responsible for loss of coverage due to equipment malfunction, power failure, defective memory cards or misuse/ theft of equipment by others. If filming is prevented due to such occurrences, all monies paid will be refunded. The Company recommends all clients to purchase adequate wedding insurance to cover such instances. The Company is insured for five million pounds public and products liability cover.

 

Production materials: If the Customer submits any media to the Company for inclusion in the edit, copyright clearance is the responsibility of the Customer (this does not apply to any music used). All materials provided by the Customer (photographs, music etc.) for the completion of the video will be returned to the Customer with the delivery of the finished product. Although all possible care will be taken to safeguard these materials, the Company is not responsible for any materials lost or damaged while in possession of the Company or in transit, beyond replacement cost.

 

Identity Privacy: As a wedding videography business we have a legitimate interest to be able to film video of clients, their guests and other persons at the venues chosen for a wedding day. This is why we need to store and use videos of people, otherwise we wouldn’t be able to call ourselves wedding videographers which is all about filming wedding parties during a wedding day. It is the customers responsibility to check that all of the persons involved with the wedding day are aware that the wedding day will be filmed and that as part of that all persons at the wedding day venues may be included. If a person does not wish their identity to be included in the videos they have their right to refuse to the customers who will then inform the business, or the guest can contact the business before or after the event to inform that they do not wish themselves or another person under their care as a parent or legal guardian to be included in any videos.

 

Property Rights: All audio and video footage is the copyrighted property of the Company. The Company reserves the right to use any and/or all footage for promotional, demonstration and internet purposes unless the Customer specifically requests (in writing) otherwise. The video DVD’s, USB sticks and Blu-Ray discs are strictly produced for the Customers private, home use or as a gift to family to friends only. Any duplication or broadcast (including internet use) without written consent of the Company is strictly prohibited. Copyright licences (to cover any music added to the video) are required by law. The company will organise the following music licenses for your production: LM (Limited Manufacturing) license covering MCPS (Mechanical Copyright Protection Society) and PPL (Phonographic Performance Limited) for physical media as well as any wedding trailer music licenses for physical and online use. The Company covers the cost of these within the package prices. The Customer is responsible for organising any other copyright or license required by individual churches, venues or musicians for their wedding.

 

 

Care of product: The Company will backup all wedding projects and hold the master copy of the film disc/s for a period of three years from the date of delivery of the disc copy to the Customer. Duplicate USB sticks, DVD’s or Blu-ray discs can be requested during this period from the master copy after which time may not be available. Although every care is taken to provide you with a high quality disc/ USB product which is thoroughly tested before handover, any defects found to be with the physical disc/s or disc content needs to be notified within 7 days of the handover date.

 

Delivery of Video Media: Delivery of the Customers video is usually around 12 weeks after the wedding day and output onto the appropriate USB sticks, DVD’s and Blu-Ray discs. This delivery schedule is approximate and every effort will be made for the finished product and copies available as soon as possible. It should be noted that all DVDs will be DVD+R format and will require a player capable of reading a DVD+R disk. Blu-ray discs require a player or console capable of reading the Blu-Ray format. USB video files are supplied in MP4 format unless requested.
